Terms of Service

These Terms govern your use of Ask Your Genes (askyourgenes.ai) and Helios (helios.askyourgenes.ai), operated by Happy To Help LLC, doing business as Human Performance Centers LLC ("HPC," "we," "us"). By creating an account, uploading a DNA file, or otherwise using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Who can use the Service

You must be at least 18 years old. You're responsible for keeping your account credentials secure and for activity that happens under your account. You agree to provide accurate information.

2. This is not medical advice

The Service is for education and personal insight only. It is not medical, diagnostic, or treatment advice, and it is not a substitute for a licensed healthcare professional. Genetic effects are probabilistic, not deterministic — your environment, behavior, and other genes all shape outcomes. Always talk to a qualified professional before acting on anything you read here.

Your genetic story and chat answers are generated by an AI model. They can be incomplete or wrong. Verify anything important with an appropriate professional.

5. Acceptable use

You agree not to: upload data you aren't authorized to use; reverse-engineer, scrape, or overload the Service; attempt to access other users' data; or use the Service to harm others or break the law.

6. Payments and refunds

Some features require payment. The fee is shown to you before you buy and is processed by Stripe. All sales are final — payments are non-refundable, except where a refund is required by law. We may change our prices at any time; the price shown at checkout is the price that applies to that purchase.

7. Availability and changes

We may add, change, or remove features, or suspend or discontinue the Service, at any time. We may also suspend or terminate accounts that violate these Terms.

8. No warranty

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, to the maximum extent permitted by law. We don't warrant that the Service will be uninterrupted, error-free, or that interpretations are complete or accurate.

9. Limitation of liability

To the maximum extent permitted by law, HPC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim.

10. Indemnification

You agree to indemnify and hold HPC harmless from claims arising out of your misuse of the Service or your violation of these Terms.

11. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. If a dispute arises, you agree to first contact us at ryder@hpcla.com so we can try to resolve it informally. Any dispute that can't be resolved informally will be handled by the state or federal courts located in Wyoming, and you and HPC agree to bring claims only on an individual basis, not as part of a class action.

12. Changes to these Terms

We may modify these Terms. If we make a material change, we'll update the "last updated" date above. Continued use after a change means you accept the updated Terms.
